A state district court granted a temporary injunction and commanded the Texas Health and Human Services Commission to refrain from taking any action to propose or implement any change in reimbursement rates for physical, occupational, and speech therapy services under the Texas Medicaid program from the date of the order – September 25, 2015 – until the date of a trial on January 18, 2016.
The court agreed that under the proposed cuts:
- the minor children represented in this lawsuit, plus thousands of other Texas children receiving pediatric services under the Texas Medicaid program will probably be deprived of those critical services;
- the State’s actions will probably create disincentives for Medicaid providers to use preventive care;
- and probably decrease the quality of care provided.
